Recently was made conservator of family member. Family member is on hospice and Medicaid. Senior has a fixed amount that comes out of her account and get 60 dollars/month for personal money. Grandmother has taxes due on the home that are now due. She has a little over 1,000 in her account after the nursing home takes their chunk for her care. Do I still pay those taxes? I am also the caretaker of the home do I pay the taxes out of my own money as I stay in my grandmother’s home for up keep.


i am also going to sell her home for her care to upgrade her care to a private room. I will have to get 3 estimates on the home/appraisal for the worth of the home. This will deplete everything she has in her bank account. Do I pay the taxes, or get the appraisals? If I pay the taxes, I will not have enough for the 3 home appraisals. If I do the appraisals, I cannot pay the taxes.

Has the judge asked for 3 actual appraisals (which are expensive and it would be unusual to ask for 3 appraisals) or has the judge asked for 3 estimates? Real estate agents will provide market estimates for you, usually for no charge in hopes of obtaining the listing.

When my Mom went on Medicaid, I stopped paying taxes. She lived in NJ and we have the highest property taxes in the country. Hers were 6k a year. We were retired paying our own taxes, could not afford hers too. If the house had not sold, I would have lost the house because of unpaid taxes. Which was OK because it was falling apart. The taxes were paid at time of closing. So was any out of pocket I had. But, if it had sold while Mom was alive, Medicaid would not guarantee I could be paid for out of pocket. You may want to talk to an elder lawyer about this.

You need to consult an attorney. This or a CPA. This is involving the loss of a house because of unpaid taxes and a Forum of us average folk (unless the very informed Igloo will weigh in) just won't cut it. This could be devastating loss. It's important that this be done right and according to the rules and laws of your own state. See an attorney for an hour of advice. Elder Law. Or consult with a CPA. Best to you and hope you will update us as to how you were advised. To me seems like if you are also the beneficiary in any way, paying the taxes is wise. Still, get best informed as well.

I spoke with an attorney in my state. He said to not pay the taxes. Once home is sold the taxes will be taken out of the home sales. He also noted that the 3 appraisals are for if I were to sell the home myself. He also noted that there will be a contract with a realtor and they will get a fair market estimate and make up a contract present it to the judge. Then a hearing with the interested parties/ children of the ward.
