I am sure you can read about our journey with LO. Details about this question. LO has been in memory care since 7/24. Thought they were adjusting well. Recently they assaulted another patient because they would not get out of their way. One other time they grabbed a staff member and hugged and kissed them. Staff at memory care informed us that if it happens again LO will have to leave. I have no problem with that and I understand. I am POA could I be sued if LO hurts someone. They do have dementia and I its all down hill. Thankfully no one was hurt. If it happens again they will send LO to ER. Seeking advice. Very troubled about the future concerning this situation.

You need to bring this up to her Neurologist. Maybe their is a med she can take. Its part of the desease. You may just need to place her in LTC.

No, you are not. In fact it is the facility that is liable for any mishaps as they are there to serve for the price paid (which I would imagine is a lot) and they are to be staffed to do so. The worst that can happen is transport to hospital ER where an admission to psyc until will result in some tries at medication.

Again, as I just said above to another poster, this sort of thing where the loved one is acting out is a nightmare. The facility cannot afford one on one care and will demand that the family does so if they are self pay, or will have the person transported to hospitalization because they cannot be handled in a unit.

There is never any liability for what a loved one of yours does to someone else as you are never in control of what a loved one, demented or no, does to anyone else. In some rare instances where you were warned to remove keys from a car and disable it, and you instread supplied keys and car to loved one you may be a part of a lawsuit. It has to be quite blatant and up front.
