I did contact Area Agency on Aging. They called me and we discussed the issues, and they did some paperwork. They told me that he would qualify for assistance. Then I received a letter in the mail stating that he qualified for the Medicaid but I needed to complete the enclosed paperwork and send it back with the requested documents. I'm not sure about releasing the documents Bank Statements, Social Security award letter, life insurance, annuities, pensions etc. with photo copies of all documents. This is for Medicaid he already has Medicare and we have health Insurance.I did call them and I'm waiting on a call back to discuss this. I have spoke to a few people and I was told to get an Attorney and separate our assets and income then complete the paperwork and send it back after it was done. I'm not feeling good about doing that because it's dishonest. The other suggestions was to file for divorce then apply and that's not right either.

You need to protect yourself. You are entitled to half of the marital assets. His half will go towards his care. I suggest you first see an elder lawyer. He can also help you with the Medicaid info and explain why Medicaid needs it.

If your husband qualifies for Medicaid in a facility, you remain in your home, have a car, and enough or all of your monthly income to pay bills. If you don't do what you need to to protect yourself, you will end up with nothing.

Yes, sorry, but Medicaid DOES need all of the above. So let them have it. This is how it is done, and believe me, you are seeing efficiency we usually do not see.

There is ABSOLUTELY NOTHING DISHONEST about doing division of assets and keeping your own assets of a marriage solid for your own use when you need it. I don't know where you got that idea. You are not hiding a ton of money to pass to the kids--that would be dishonest. You are a partner and half assets are your own assets.

Yes, see that attorney who will help you also with your application and reassure you.

Dea, please see an attorney about getting the assets split. This is not illegal and is intended to protect the spouse that doesn't need a facility.

It makes no sense to place a loved one in care and end up homeless yourself, our system has stop gap measures for this, use them.

It sounds like you are looking into long term care medicaid, not community medicaid, two vastly different programs.

A good certified elder law attorney will be able to help you understand what the process is and how to best protect you and your husband. At the very least, you will have a better understanding of what is available for helping you help your husband.
