Hi-My mom now has functional dementia (no POA) and has been using a tax preparer with no problem. Now she is in a facility and I am not sure how to get her taxes done for her. I am trying to get the person who stays at her place to gather documents and take her to the preparer but they cant seem to find all her docs. I made a list of what the preparer used last year, like 1099s. Im not even sure the person is looking hard enough. I live out of town and can not travel. I can not gather tax documents online either. Not sure how to approach this, thanks

Does she need to file taxes for 2024? Did she actually earn enough to have to file? Did she do any transactions that would cause her to have to file? If you have trouble getting the proper documents for her you can have the tax preparer file an extension.

Considering that literally NO ONE could survive on just $16,550 a year, the threshold for income for those over 65, its a given that she has to file.

The best thing you can do is Hire a Tax Preparer to go to her. With her signature on some forms, they can download her transcripts and file for her using those transcripts.

Thank, to be clear, She used a tax preparer to do last year's taxes. If I understand, I can contact them and they can get this year's tax documents to do her taxes. Documents like her pension, Bank forms and such.

I’m unclear what is meant by “functional dementia” but mom definitely needs a POA for healthcare and financial decisions if she’s still capable of doing so. If the person responsible can't or won’t locate what’s needed, you’ll need to locate another local person to find them. Perhaps the facility administrator can point you in the right direction to find local help

A POA wont be forthcoming and there is no one else to locate her documents. The facility she is almost useless and impossible to reach. I may have to turn this over to an agency or something if her tax documents cant be found.
